RotaTalk Terms and Conditions

1. Service Description

RotaTalk ("we," "us," or "our") provides a voice communication platform primarily designed for licensed professional drivers and related logistics professionals to share road-related information and assist each other with navigation and other industry-related queries.

2. Definitions

"Professional Drivers" means individuals operating commercial vehicles under relevant local, state, or national licensing and regulation. The Service is intended for such users and related industry professionals.

3. Acceptance of Terms

By accessing or using RotaTalk, you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these Terms, you may not access or use the Service.

4. User Eligibility and Account Registration

4.1. You must be at least the minimum age of digital consent in your country, or the age specified by the app's local rating on your device's app store (such as the App Store or Google Play), whichever is higher, to use the Service. By using RotaTalk, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are under 18, you represent that you have permission from a parent or legal guardian where required by law.

4.2. You must register with accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials.

5. Safe Use and Compliance with Laws

5.1. Usage While Driving and Risk Acceptance: By using RotaTalk while operating a vehicle, you explicitly acknowledge and accept that:

  • You will use the app only in a manner that does not distract from safe driving,
  • You will fully comply with all applicable traffic laws, regulations, and safety standards,
  • You fully and exclusively accept the risk of any accidents, injuries, property damage, traffic violations, or other harm that may result from using the Service while driving,
  • You accept that RotaTalk shall not be held liable in any way for such incidents.

WARNING: Distraction while driving can lead to fatal accidents. For your safety, use the app only in safe conditions or prefer hands-free features.

5.2. RotaTalk is not an emergency service. In the event of an emergency, contact local emergency services. You must not rely solely on RotaTalk for urgent assistance.

5.3. RotaTalk does not provide professional, legal, medical, or safety advice. Information shared is for general informational purposes only and should be independently verified.

5.4. Microphone Usage and Responsibility: You acknowledge and accept full responsibility for when your microphone is activated and deactivated. You are solely responsible for exercising due care and attention to ensure that your microphone is not unintentionally left on. RotaTalk does not monitor, supervise, or evaluate any content transmitted through your microphone during live voice communication. You are entirely responsible for all information, opinions, or content that you speak, hear, or share while your microphone is active. RotaTalk shall not be held liable in any way for any incidents, opinions expressed, information shared, or consequences thereof that occur during voice communication sessions.

5.5. Child Safety and Protection of Minors: You must not share, distribute, or promote any content involving the exploitation or endangerment of minors, including but not limited to child sexual abuse material (CSAM). Any violation of this policy may result in immediate suspension or termination of your account and reporting to appropriate authorities.

5.6. International Usage and Local Law Compliance:

5.6.1. Users are obligated to comply with traffic laws, road safety standards, and electronic communication regulations of the country or region where they use the app.

5.6.2. In some countries, live voice communication or mobile app usage while driving may be prohibited or restricted. Users are responsible for learning and complying with the laws of their location.

5.6.3. If using RotaTalk while driving is prohibited in the user's country, the user agrees not to use the app.

5.6.4. RotaTalk accepts no responsibility for users violating local laws, traffic violations, or legal sanctions.

5.6.5. Users traveling across borders are separately obligated to comply with the laws and regulations of each country they pass through.

6. Acceptable Use Policy

6.1. Permitted Uses:

  • Sharing road and traffic conditions
  • Providing navigation assistance and directions
  • Sharing information about border crossings and customs conditions
  • Offering general assistance and guidance to fellow drivers
  • Sharing safety-related information and alerts

6.2. Prohibited Uses:

  • Commercial solicitation or advertising of cargo transportation services
  • Posting or sharing cargo availability or transportation requests
  • Conducting any form of trade or commercial transactions
  • Sharing false, misleading, or deliberately inaccurate information
  • Harassing, abusive, or discriminatory behavior
  • Any illegal activities or promotion of illegal content
  • Sharing personal or sensitive information of others without consent

6.3. Social Feed Content Rules:

Voice posts in the Social Feed must not contain any of the following:

  • Hate speech, harassment, discrimination, or content targeting individuals or groups based on protected characteristics.
  • Personal or sensitive information of others without their explicit consent.
  • Unverified or exaggerated information and claims that may cause panic, fear, or public outrage; statements that may disturb public order.
  • Unauthorized statements, announcements, or warnings that give the impression of being made on behalf of police, gendarmerie, health services, customs, municipalities, ministries, or other public authorities.
  • Any expression that encourages, promotes, or legitimizes violence, suicide, or self-harm.
  • Content that promotes the use of alcohol, drugs, stimulants, performance-impairing substances, or illegal substances, or normalizes driving while under their influence.
  • Repeated, deliberate, or irresponsible sharing of false information that may mislead users about traffic, road conditions, border crossings, customs procedures, or security matters.
  • Spam-like, repetitive, meaningless, out-of-context voice posts, or posts intended to abuse the system in ways that undermine the purpose of the Social Feed.
  • Commercial solicitation, advertising, or promotion of products and services.
  • Gambling, betting, games of chance, or high-risk financial guidance, including direct or indirect promotion.
  • False accusations of crime, defamation, insults, or reputation-damaging statements directed at individuals or legal entities.
  • Calls, links, or suggestions intended to direct users to off-platform applications, groups, or services.
  • Posts that give the impression of speaking as another person, institution, or public official; including voice imitation, synthetic voice generation, or identity deception.
  • Copyrighted material, including music, audio clips, or other protected content without proper authorization.
  • Any content that is clearly contrary to law, public morality, or the platform's intended safe use purpose.

Violations may result in post removal from feed, account suspension, or permanent ban.

7. Information Sharing and Moderation

7.1. Information Accuracy and Disclaimer: RotaTalk is a communication platform; we do not verify, endorse, or guarantee the accuracy, completeness, reliability, or currency of information shared by users. All information provided by users is shared "as is."

7.2. Liability for Incorrect or Misleading Information:

  • RotaTalk shall not be held liable in any way for damages, delays, route deviations, financial losses, or other adverse consequences resulting from incorrect, misleading, or incomplete information shared on the platform.
  • Users are obligated to verify information obtained through the platform from independent sources (official traffic notifications, navigation apps, authorities) before making decisions based on it.
  • No user content, including information shared by channel administrators and moderators based on their experience, is considered verified or endorsed by RotaTalk.

7.3. Independent Verification Requirement for Critical Decisions: Users must always verify information received through the platform from official sources before taking action on critical matters such as route changes, border crossings, weather assessments, or emergencies. The platform is merely an information-sharing tool; the final decision and responsibility rest entirely with the user.

7.4. User-to-user blocking is available through Menu → Privacy & Safety → Blocked Users. When you block a user, it is mutual: neither party can see, hear, or interact with the other across the entire platform.

8. Channel Moderation

8.1. Channel administrators have the authority to:

  • Mute microphones of users who violate rules
  • Issue warnings or temporary bans
  • Ban accounts for repeated or severe violations
  • Set and enforce channel-specific rules
  • Manage speaking privileges

8.2. Administrator actions are discretionary but must be consistent with these Terms and platform guidelines.

8.3. Feed Post Moderation

8.3.1. Users can report voice posts for review.

8.3.2. Channel administrators may request review of reported posts linked to their channels.

8.3.3. Reported posts are reviewed within 48 hours.

8.3.4. Posts violating policies are removed from public visibility; repeat offenders face account action.

8.3.5. Post removal reasons are provided upon request by the post owner.

8.5. My Teams (Private Channels)

8.5.1. Creation and Use

RotaTalk allows users to create Teams—private voice channels accessible only through invite links. By creating a Team, you agree to the following:

  • You are solely responsible for the content and conduct within your Team
  • Teams must comply with all applicable laws and regulations
  • Teams cannot be used for illegal activities, including but not limited to:
    • Coordinating illegal cargo transportation or trafficking
    • Sharing false emergency information
    • Harassment or threats against other users
    • Distribution of illegal content
  • You maintain Team ownership and can manage members (remove or ban users)
  • Team creation limits apply based on your subscription tier (free or premium)

8.5.2. Invite Links and Access Control

Teams use invite links for member access:

  • Invite links should only be shared with intended recipients
  • You are responsible for who you invite to your Team
  • RotaTalk is not liable for unauthorized sharing of invite links
  • Team owners can enable or disable new member acceptance at any time
  • Team owners can remove members or ban users from their Team

8.5.3. Owner Responsibilities

As a Team owner, you have additional responsibilities:

  • Ensure your Team members comply with these Terms and Acceptable Use Policy
  • Monitor Team activity and report violations to RotaTalk
  • Maintain appropriate Team naming and descriptions
  • Respect the privacy and safety of Team members

8.5.4. Law Enforcement Compliance

While Teams are intended for private group communication, RotaTalk cooperates with law enforcement authorities:

  • Team metadata (member lists, creation date, ownership) may be provided to authorities with a valid legal order
  • Voice communication is not recorded by default (see Section 9.6 on Voice Recording)
  • User reports of illegal activity in Teams will be investigated
  • RotaTalk reserves the right to delete Teams used for illegal purposes without prior notice

8.5.5. Consequences of Misuse

Misuse of Teams may result in:

  • Immediate Team deletion without notice
  • Permanent account suspension
  • Device bans preventing future account creation
  • Reporting to relevant authorities for illegal activities
  • Legal action for violations of applicable laws

8.5.6. Feature Availability

RotaTalk reserves the right to:

  • Disable or modify the My Teams feature at any time without prior notice
  • Restrict My Teams access in specific regions as required by local laws
  • Suspend My Teams functionality during security incidents or investigations
  • Terminate Teams that violate these Terms or pose risks to user safety

9. Privacy and Data Protection

9.1. Location data is used only for essential Service functionality and is not shared with third parties, except as required by law. The visibility of other users on the map is conditional upon your own choice to share your location via the "Live Location Sharing" feature.

9.2. RotaTalk does not record or retain live audio from real-time voice communication channels. However, the Social Feed feature allows users to create and publish voice recordings ("Voice Posts"). Voice post audio files are retained for up to 2 years for legal compliance, safety investigations, and regulatory purposes, even after user deletion or expiration. Posts may be hidden from the feed but retained in our systems. Where required by law, we may preserve limited metadata (e.g., timestamps, channel identifiers) for security and compliance purposes.

9.3. User data is handled in accordance with our Privacy Policy and applicable data protection laws.

9.4. Third-Party Services

9.4.1. Our Service integrates with third-party providers including analytics services, error tracking, and push notification providers.

9.4.2. These services may collect and process your data according to their own privacy policies in addition to ours.

9.4.3. Analytics data is collected to improve the Service and cannot be opted out. See our Privacy Policy for details on what data is collected and how it's used.

9.5. Personal Data Protection (GDPR/KVKK) Compliance

9.5.1. Data Controller

The data controller for personal data collected in the RotaTalk service is Nesim Tunc. You can submit your data protection requests to legal@rotatalk.com.

9.5.2. Personal Data Collected

When using the Service, the following personal data is processed:

  • Identity Information: Username, full name, email address, phone number (optional)
  • Profile Information: Avatar image, bio (optional), license plate (optional)
  • Location Data: Only your last known location when you activate "Live Location Sharing" (no historical tracking)
  • Device Information: Device ID, brand, model, operating system, app version, IP address
  • Usage Data: Channel participation, session duration, feature usage (for analytics, pseudonymized)
  • Communication Metadata: Voice communication timestamps and channel IDs (audio content is not recorded)

9.5.3. Data Processing Purposes

Your personal data is processed only for the following purposes:

  • Providing and operating the Service (contract performance)
  • User authentication and account management
  • Providing live voice communication and location sharing services
  • Platform security, abuse prevention, and ban evasion detection (legitimate interest)
  • Service improvement and debugging (legitimate interest)
  • User support and communication
  • Fulfilling legal obligations

9.5.4. Data Retention Periods

9.5.5. Data Transfers and Third Parties

Your data is shared only with the following third-party service providers necessary for service delivery:

  • Supabase (Germany/EU): Database and authentication - GDPR-compliant DPA
  • Voice Communication Infrastructure (Our own server - Germany): Real-time audio streaming - Not a data processor
  • Amplitude (EU data center): Anonymous usage analytics - GDPR compliant
  • Sentry (Germany/EU): Error tracking - GDPR-compliant DPA
  • OneSignal (USA): Push notifications - With Standard Contractual Clauses (SCC)
  • Resend (USA): Transactional emails - GDPR-compliant DPA
  • Google Maps: Map display - Google Data Processing Terms
  • Shorebird (USA): Over-the-air app updates - collects app version and platform information

Transfers outside the EU/Turkey are secured with Standard Contractual Clauses (SCC).

9.5.6. Data Subject Rights

Under GDPR and KVKK, you have the following rights:

  • Right to information: Learn what data is being processed
  • Right of access: Request a copy of your data
  • Right to rectification: Request correction of inaccurate data
  • Right to erasure: Request deletion of your data under "right to be forgotten"
  • Right to object: Object to data processing activities
  • Right to data portability: Receive your data in structured format
  • Right to complain: File a complaint with the Personal Data Protection Authority (KVKK) or local data protection authority

To exercise these rights, contact legal@rotatalk.com. Your requests will be answered within 30 days.

9.5.7. Analytics Data and User Control

Amplitude analytics service is used for service improvement and user experience optimization. Collected data is processed using pseudonyms, and your personal identification information (email, phone) is not shared with Amplitude.

Important: Analytics tracking is currently enabled by default. Future updates may provide an option to disable analytics data from within the app.

9.5.8. Data Security

We implement the following technical and administrative measures to protect your personal data:

  • Data transmission with TLS 1.3 encryption
  • Row-Level Security (RLS) policies at database level
  • JWT-based authentication and authorization
  • Regular security updates and patch management
  • Access control and role-based authorization
  • Pseudonymized log records

9.5.9. Data Breach Notification

In the event of a data breach affecting the security of your personal data:

  • Relevant authorities will be notified within 72 hours
  • Affected users will be informed in a reasonable timeframe
  • Measures taken and user actions required will be explained

Data breach notifications are made via legal@rotatalk.com.

9.6. Voice Recording and Social Feed

9.6.1. Live Voice Communication: RotaTalk does not record or store live voice communication streams from real-time channels. All live voice communication is processed in real-time (ephemeral) and is not stored on servers.

9.6.2. Metadata Recording: For security and abuse prevention purposes, limited metadata (e.g., timestamps, channel IDs, speaking duration) may be recorded. This data does not include audio content from live channels.

9.6.3. Social Feed Voice Posts: RotaTalk provides a Social Feed feature where users can record, publish, and share voice posts. By using this feature, you explicitly consent to:

  • Recording and storage of your voice content on our servers
  • Retention of voice files for up to 2 years for legal compliance and safety investigations, even after deletion or expiration
  • Public or channel-based visibility of your posts as selected
  • Optional attachment of geo-location data (enabled by default if location permission granted, can be disabled per post)
  • Collection of engagement analytics (plays, impressions, reactions) visible to authenticated users
  • Storage according to your selected expiration (1 day, 3 days, 7 days, or indefinite)

9.6.4. Voice Post Ownership and License: You retain ownership of voice content you create. By posting, you grant RotaTalk a non-exclusive, royalty-free, worldwide license to store, display, distribute, and make available your voice posts through the Service, including via deep links (accessible only to authenticated app users). This license continues for the full retention period.

9.6.5. Content Moderation: Voice posts may be reported by users and reviewed for violations of our Acceptable Use Policy. We reserve the right to remove posts from public visibility and suspend accounts for policy violations without prior notice. Post removal reasons are available upon request to the post owner.

9.6.6. Legal Retention: Voice posts and associated metadata are retained for legal compliance, safety investigations, and regulatory requirements for up to 2 years after deletion, expiration, or account termination. The retention period begins from deletion (if deleted by user), from expiration (if expired), or continues indefinitely for posts set to never expire. This retention supports investigation of reported content and compliance with legal obligations.

9.6.7. Disclosure to Authorities: Voice posts and associated data may be disclosed to law enforcement, judicial authorities, or regulatory bodies when required by law, court order, or when we have a good faith belief that disclosure is necessary to prevent crime, protect user safety, or comply with legal obligations.

10. Service Limitations

10.1. We provide the Service on an "as is" and "as available" basis without warranties of any kind, express or implied.

10.2. We may experience technical difficulties or require maintenance that could affect Service availability.

10.3. We reserve the right to modify or discontinue features with reasonable notice.

11. User Content and Conduct

11.1. You are responsible for all content shared through your account and agree not to share instructions or information that encourages unlawful or unsafe behavior.

11.2. You agree to:

  • Communicate respectfully with other users
  • Share accurate information to the best of your knowledge
  • Report inappropriate content or behavior
  • Follow channel-specific rules and guidelines

11.3. Device Management and Bans

11.3.1. We may ban devices that violate our terms. Device bans may affect all accounts used on that device.

11.3.2. User bans may be enforced across devices to prevent evasion attempts.

11.3.3. Device identifiers are used for security purposes and ban enforcement.

11.3.4. Attempts to evade bans through multiple accounts or devices may result in permanent suspension.

11.4. User Blocking System

11.4.1. The Service provides a user-to-user blocking feature that allows you to block other users from communicating with you and accessing your content.

11.4.2. You agree to use the blocking feature responsibly and not to abuse it as a means to harass or manipulate other users.

11.4.3. Creating multiple accounts or using other means to circumvent another user's block is strictly prohibited and may result in account suspension or device banning.

11.4.4. The blocking feature is mutual - when you block another user, they are also unable to see or communicate with you, even if they have not initiated the block.

12. Intellectual Property

12.1. All trademarks, logos, and service marks displayed on RotaTalk are our property. You may not use them without our prior written permission.

12.2. User Content License:

12.2.1. You retain ownership of content you create, including voice posts.

12.2.2. By publishing content (including voice posts), you grant RotaTalk a non-exclusive, royalty-free, worldwide, sublicensable license to:

  • Store, host, and backup the content
  • Display and distribute through the Service
  • Create deep links for sharing (app access only)
  • Transcode or optimize for different devices
  • Retain for legal compliance and safety investigations

12.2.3. This license continues for the full retention period, including post-deletion retention for legal compliance.

12.2.4. You represent that you have all rights necessary to grant this license and that your content does not infringe third-party rights.

13. Subscription and Payments

13.1. Certain features may require a paid subscription.

13.2. Subscription terms and pricing will be clearly communicated before purchase.

13.3. Refunds are handled according to the platform's refund policy and applicable laws.

14. Indemnification

14.1. You agree to defend, indemnify, and hold harmless RotaTalk, its affiliates, and their respective officers, directors, employees, and agents from any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

15. Limitation of Liability

15.1. In no event shall RotaTalk be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of or inability to use the Service.

15.2. Comprehensive Liability Disclaimer: RotaTalk shall not be held liable for any damages arising from the following:

  • User Information: Consequences resulting from information shared by users being incorrect, misleading, incomplete, or outdated
  • Reliance on Information: Decisions made based on information obtained through the platform and their consequences
  • Navigation and Routes: Delays, extra costs, or losses resulting from route decisions based on shared road information
  • Traffic and Accidents: Accidents, injuries, or traffic violations resulting from using the app while driving
  • Service Interruptions: Service interruptions resulting from technical issues, maintenance work, or network problems
  • Data Loss: Data loss resulting from technical failures, security incidents, or user errors
  • Third-Party Services: Issues resulting from errors in integrated third-party services (map providers, analytics services, etc.)
  • User Behavior: Harm resulting from inappropriate, harassing, or illegal behavior by other users
  • Voice Posts: Consequences resulting from voice posts including reputation damage, misinterpretation of content, or unintended disclosure of information
  • Location Disclosure: Consequences of geo-location data attached to posts revealing user whereabouts at time of recording
  • Post Retention: Cached or retained posts remaining in our systems after deletion for legal compliance purposes

Important: Users acknowledge that they should not make decisions without independently verifying all information obtained through the platform and conducting their own research. The platform is merely an information-sharing tool; the final decision and responsibility rest entirely with the user.

16. Disclaimer of Warranties

16.1. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

17. Changes to Terms

17.1. We may update these Terms with reasonable notice to users.

17.2. Continued use of the Service after changes constituees acceptance of the updated Terms.

18. Governing Law and Dispute Resolution

18.1. These Terms are governed by the laws of Türkiye, without regard to its conflict of law provisions.

18.2. Any disputes arising under these Terms shall be resolved in the competent courts of İstanbul, Türkiye, unless otherwise required by applicable law.

19. Severability and Entire Agreement

19.1. If any provision of these Terms is held to be invalid or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.

19.2. These Terms constitute the entire agreement between you and RotaTalk regarding the use of the Service, superseding any prior agreements.
